The purpose of www.jusboxperfumes.com is the sale to natural and legal persons, in compliance with Italian laws on distance contracts.

Sales are governed by these Terms and Conditions, as well as by the specific procedures that are detailed in the PAYMENT TERMS, SHIPPING INFORMATION and PRIVACY POLICY sections of this website, which form an integral and essential part of the sales agreement. Before placing an order, customers are therefore advised to carefully read the above-mentioned sales conditions and the information contained therein, and to print or save them on another durable medium that they can access.

Any amendments or new sales conditions shall be promptly notified to Customers. They shall enter into force as of the moment of their publication on this website and shall only apply to sales performed after the publication.

The Customer’s submission of the order is deemed as an acceptance of the sales conditions in force at that time.

Article 1 General Terms and Conditions

These General Terms and Conditions apply to all distance sales of “Jusbox Perfumes” products concluded through the www.jusboxperfumes.com website.

The distance sales service described in these General Terms and Conditions is intended for the exclusive use of consumers (hereinafter referred to as “Customers” or “Customer”), i.e., natural persons over 18 years of age (or, where minors under 18, authorised by their natural or legal guardian) who act for purposes not related to any commercial, artisanal, entrepreneurial or professional activity they may perform.

On the website, the sales agreement is available in Italian and English. This is a translation provided only for your convenience. Only the Italian text has legal value.

Customers are required to read carefully the General Terms and Conditions available on the Website in order to understand them and are advised to save and reproduce them in accordance with Article 12, paragraph 3, of Italian Legislative Decree 70 dated 9 April 2003 (“Implementation of Directive 2000/31/EC on certain legal aspects of services supplied by information companies within the domestic market, with particular reference to e-commerce” – hereinafter the “e-commerce Decree”). Contracts concluded with Beauty San S.p.A. on the website are regulated by the Italian Law and, in particular, by Legislative Decree 206 dated 6 September 2005 (hereinafter, the “Consumer Code”) and the e-commerce Decree. The seller is Beauty San S.p.A., with registered offices in Viale Giovanni Milton 27, 50129, Florence (Italy), VAT and fiscal code No. 04604720484, Economic and Administrative Index No. REA FI – 464680, and operating offices in via Rimini 37, 59100, Prato (Italy). Before submitting any order proposal, Customers are advised to read and understand the instructions provided during the purchasing process and in these General Terms and Conditions, as they will become binding upon finalization of the sales agreement.

Art. 2 - Conclusion of the Sales Agreement

In order to be valid, the order that the Customer submits to Beauty San S.p.A. must be completed in full and must include all the necessary information to identify both the Customer and the ordered products, as well as the delivery address. Beauty San S.p.A. shall send to the Customer, via e-mail, a confirmation of the order receipt containing a reference to the sales terms and conditions in force. In accordance with Article 53 of the Consumer Code, upon order confirmation or performance of the contract, Beauty San S.p.A. shall send an email to the Customer containing the main General Terms and Conditions, the main details of the products purchased, detailed information on price and payment methods, information on shipping costs, information regarding the conditions and procedures to exercise the right of withdrawal, Beauty San S.p.A.’s address to lodge a complaint, as well as information on customer care services and available commercial warranties. Customers shall immediately and carefully read the email content and notify any mistakes or omissions to Beauty San S.p.A. Without prejudice to the use of personal data described in the Privacy Policy and subject to Customers’ explicit consent, the form containing the order proposal and all the relevant data provided by Customers will be retained by Beauty San S.p.A. for the time specified by applicable regulations in force.

 

Art. 3 - Availability and Delivery

Beauty San S.p.A. undertakes to accept orders within the limit of the stocks of available goods. In specific circumstances, Beauty San S.p.A. could be unable to guarantee the availability of all of the products offered, and it therefore cannot be held liable for the temporary unavailability of one or more products.

The order submitted by Customers shall be deemed as acceptance of a possible partial delivery, including only the products available amongst those ordered, as well as a waiver of the right to claim compensation or indemnities for any damages. In addition, pursuant to applicable laws, Beauty San S.p.A. undertakes to promptly inform the Customer of the possible unavailability of the product ordered.

If the product, despite Beauty San S.p.A.’s thorough control measures, is temporarily unavailable at the time of payment confirmation, Beauty San S.p.A. reserves the right to suggest a substitute item of the same quality and price, without charging any additional costs to the Customers. Should that not be possible, or should the Customers refuse to receive a substitute item, they may decide whether to wait for the ordered product to become available again or to cancel the order, without any additional costs whatsoever.

In case of permanent unavailability, should it not be possible to supply an item of the same quality and price, the order will be automatically cancelled and the Customer will be immediately refunded.

Beauty San S.p.A. delivers the product or products ordered by the Customer according to Article 5 below and the conditions clearly stated in the website, under section "Shipping Information".

 

Art. 4 - Prices and payment methods

The prices stated on www.jusboxperfumes.com are in euro and are inclusive of VAT. 

Shipping costs are excluded; where due, they are stated separately.

The prices applied are those indicated in the website when the order is placed by the Customer. The prices of individual products are subject to change and therefore the prices indicated on the site from time to time void and supersede those previously indicated. The price of the products purchased, together with the cost of home delivery, where applicable, must be paid by the Customer when placing the online order, using a credit card or other appropriate methods. Tax documentation will be issued by Beauty San S.p.A. upon delivery. Invoices must be requested in advance and the information provided by the Customer when placing the order will be used. No changes to invoices will be possible after they have been issued.

Customers may use one of the methods indicated on the order form to pay the price of the products and the related shipping and delivery costs. Under no circumstances will Customers be charged costs in excess of those actually borne by the Seller, in respect of the chosen means of payment. For customer security reasons, Beauty San S.p.A. never has access to credit card numbers; this information is only received by the banking system, which has to authorise payment. Beauty San S.p.A. is sent the transaction outcome only. Accordingly, no credit card information will be included in order documents or stored in Beauty San S.p.A.’s systems or those of the express courier.

 

Art. 5 - Shipments

Deliveries take place via Express Courier only. Deliveries to post office boxes are not accepted.

In Europe, items are generally delivered within 48/72 hours from the moment the courier accepts to proceed with the delivery.

It should be noted that these delivery times are those indicated by the express courier and Beauty San S.p.A. cannot guarantee them. However, on the basis of past experience, they are generally respected.

Items will be delivered from Monday to Friday, during the usual working hours.

In case of a missed delivery due to the recipient’s absence, upon the second attempt, the Courier will leave a shipping note containing the address to contact in order to schedule a new delivery.  

Beauty San S.p.A. will do everything in its power to have the products delivered to the Consumer within the above-mentioned terms.

The consumer is encouraged to contact [email protected] in case of delay in delivery and in any case to report any inefficiency detected. Beauty San Spa is not responsible for delays not foreseeable and/or attributable solely to the Courier. In any case, except in cases of force majeure or unforeseeable circumstances, in accordance with Article 54 of the Consumer Code, the Products will be delivered within a maximum period of 30 (thirty) days from the day following the conclusion of the contract in accordance with Article 2.

 

Art. 6 - Right of Withdrawal

In accordance with Article 52 of the Consumer Code, Customers have the right to withdraw from the agreement without any penalties and without specifying the reason, within 14 days from the receipt of the goods, by prior written communication to be forwarded to: Beauty San S.p.A., Via Rimini 37, 59100, PRATO (ITALY). In the communication, Customers shall specify the product/s on which they want to exercise the right of withdrawal. The written communication shall specify:

the intention to exercise the rights granted by law;

the indication of the purchased product;

A copy of the original sales letter that the Customer has received

Item code/s, in case of partial withdrawal.

Bank details for the transfer (IBAN Code of the Customer’s current account, and BIC/SWIFT Code for foreign Customers).

Customers are only required to pay the shipping costs. The right of withdrawal shall exclusively apply to items that are intact upon return.

According to law, Beauty San S.p.A. undertakes to refund the Customer in the manner and terms agreed upon by the parties. Alternatively, and exclusively with the prior consent by the Customer, it will be possible to provide a substitute product.

The right of withdrawal cannot be exercised if the product is not intact, i.e.:

  • in absence of the original packaging;
  • in absence of integral elements of the product (accessories, gifts, etc.);
  • if the product is damaged.

The right of withdrawal cannot be exercised in case of customized product.

The right of withdrawal can be exercised exclusively by Consumers (i.e., natural persons who purchase goods for purposes not related with their professional, commercial or entrepreneurial activity); therefore, it cannot be exercised by legal entities or natural persons who act for purposes related to the professional activity they may perform.

Return costs are borne by the Customer.

 

Art. 7- Return of Damaged Goods

In case of delivery of an item that has been damaged during transport, Customers are not charged any costs, since Beauty San S.p.A. is responsible for the transport of goods. In any event, in case of possible damage, Beauty San S.p.A. kindly asks Customers to sign the delivery note and write “unchecked” in order to help it to improve its service.

 

Art. 8 - Warranty and Responsibility

Within the limits of availability described above, Beauty San S.p.A. guarantees the delivery of products that are identical to those indicated and described in the website. Beauty San S.p.A. guarantees the authenticity of the products.

Manufacturer’s responsibility shall apply to all of the products sold. In case of packaged products, the manufacturer is also responsible for the truth and completeness of the information provided on the packaging. On the website, images are provided for the sole purpose of facilitating Customers’ identification of the products.

Art. 9 - Disputes and Governing Law

All distance sales agreements entered into with Beauty San S.p.A. are governed by the laws of the Italian Republic and any civil disputes concerning their application, execution and interpretation shall be resolved by the Court of Florence. With regard to any matter not expressly addressed by this agreement, the applicable Italian laws in force shall apply.
